Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using the Sonora mobile application ('App'), you agree to be bound by these Terms of Use ('Terms', 'EULA'). If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of those changes. Please review these Terms periodically. These Terms also incorporate by reference our Privacy Policy, available at Privacy Policy.

2. License to Use the App

Sonora grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service, or on any Android devices as permitted by the Google Play Terms of Service, subject to these Terms. You agree not to use the App for any other purpose, or to copy, modify, distribute, sell, or lease any part of our App, nor to reverse engineer or attempt to extract the source code of the App, unless laws prohibit these restrictions or you have our written permission.

3. Subscriptions & Auto-Renewal

Certain features of the App, such as Premium Sounds or Animated Soundscapes, may require you to purchase an auto-renewing subscription ('Subscription').

Subscription Periods and Pricing

We may offer Subscriptions for various periods (e.g., 'Monthly Subscription', 'Annual Subscription'). The current pricing for each Subscription period will be clearly displayed to you within the App at or before the time of purchase. All prices are subject to change. We will provide you with reasonable notice of any price changes as required by applicable law or platform policies.

Payment

Payment will be charged to your Apple App Store (iTunes) or Google Play Store account ('App Store Account') at confirmation of purchase. You authorize the respective App Store to charge your account for the Subscription fee chosen.

Auto-Renewal of Subscription

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each subscription period (e.g., monthly or annually) for the same duration and at the then-current price for that subscription type, unless you cancel your subscription at least 24 hours before the end of the current subscription period. Your App Store Account will be charged for renewal within 24-hours prior to the end of the current period.

Managing and Cancelling Subscriptions

Subscriptions may be managed by you, and auto-renewal may be turned off, by going to your App Store Account settings after purchase. For Apple devices, you can manage subscriptions via your device Settings → [Your Name] → Subscriptions. For Android devices, you can manage subscriptions via the Google Play Store app → Menu → Subscriptions. If you cancel your Subscription, you will continue to have access to the Premium Features until the end of your current paid Subscription period, but it will not renew.

Free Trials

If we offer a free trial period for any Subscription, the specific terms (e.g., duration) will be provided at the start of the trial. Unless you cancel the Subscription at least 24 hours before the end of the free trial period, your Subscription will automatically convert to a paid Subscription upon expiration of the free trial, and your App Store Account will be charged the applicable Subscription fee. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a Subscription, where applicable.

Refunds

All purchases and subscription fees are final and non-refundable, except as expressly stated in these Terms, as required by applicable law, or as determined at the sole discretion of Apple or Google through their respective App Store policies. If you believe you are entitled to a refund, please contact Apple App Store Support or Google Play Store Support directly.

Third-Party Subscription Management

We use RevenueCat to help manage subscription status and validate purchases. This service interacts with your App Store Account to confirm your subscription entitlements.

4. User Accounts

Account Creation

You may optionally create an account using Google Sign-In or Apple Sign-In. Account creation is not required to use the App or access any features, including premium subscriptions. Creating an account allows you to sync certain preferences across devices.

Account Security

If you create an account, you are responsible for maintaining access to your Google or Apple account used for sign-in. Sonora does not store your password; authentication is handled entirely by your chosen sign-in provider through Firebase Authentication.

Account Deletion

You may delete your account at any time through the App's settings. Upon deletion:

• Your account data (email address and user identifier) is deleted immediately
• Your local preferences remain on your device until you uninstall the App
• Any active subscriptions remain valid as they are tied to your anonymous identifier, not your account

Relationship to Subscriptions

Subscriptions are managed through your App Store Account and are independent of your Sonora account. You can have a subscription without creating a Sonora account. Deleting your Sonora account does not cancel or affect your subscription.

5. Communications

Newsletter

You may optionally subscribe to our newsletter to receive updates, tips, and information about Sonora. You can unsubscribe at any time through the App settings or by contacting us. We will not send marketing communications without your consent.

Service Communications

We may send you service-related communications (such as changes to these Terms or our Privacy Policy) regardless of your newsletter preferences, as these are essential to your use of the App.

6. Intellectual Property Rights

All content in this App, including but not limited to sounds, music, graphics, text, logos, and software, is the property of Sonora or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material in our App, except as generally permitted through the App's functionality for your personal, non-commercial use.

7. User Conduct

You agree not to use the App in any way that:

• Violates any applicable national or international law or regulation
• Is fraudulent, or has any unlawful or fraudulent purpose or effect
• Attempts to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App

8. Disclaimers and Limitation of Liability

The App is provided on an 'AS IS' and 'AS AVAILABLE' basis. Sonora makes no warranties, express or implied, regarding the App's operation or your use of the App, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Sonora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your transmissions or content. Our total liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your access to our App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. If your Subscription is terminated, you will not be entitled to any refund for any unused portion of your Subscription term, unless required by law.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Solothurn, Switzerland.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice (e.g., by posting a notice within the App or on our website) prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the App.
